1. Parties

Side one www.hiskulture.com, which operates the website Neighbourhood of Akat , Menekse Street, No: 27 Besiktas / ISTANBUL resident Scyllium Tasarım İletişim Perakende Hizmetleri A.Ş (Hereinafter referred to as ‘Scyllium’) with on the other side www.hiskulture.com this contract has been concluded between the internet user (‘member’) who is a member of the website under the following terms.

2. Definitions

Scyllium : www.hiskulture.com , which operates the website neighbourhood of Akat, Menekse Street, No: 27 Besiktas / ISTANBUL resident Scyllium Tasarım İletişim Perakende Hizmetleri A.Ş.’dir.
Site: www.hiskulture.com it is a website that can be accessed from an online  environment in which various services and content are offered within the framework established by it.
Member: a natural or legal person who is a member of the site and uses the services offered on the site in accordance with the terms set out in this agreement.
Buyer: a member who buys goods and/or services offered for sale by using the services offered on the site.

3. Subject Of The Contract

Subject of this Contract; Scyllium Tasarım İletişim Perakende Hizmetleri A.Ş.'s website owned by www.hiskulture.com it is the determination of the rights and obligations of the parties to these services, the terms of use of the member, and the services provided.

4. Commencement Of The Contract

4.1. After the member completes the registration process on the Site and confirms the email address provided that it comply with the terms set out in this Contract, can start using the Site by entering his email address and password.
If the contract is concluded on behalf of a legal entity, the person who concluded the contract is authorized to perform such a transaction on behalf of the legal entity in question, otherwise (in case of unauthorized transaction), after that, he/she accepts, declares and undertakes that he/she is personally responsible for all consequential actions that he/she makes / will make.

4.2. Being a minor to become a member of the site, for members of a legal entity; to be authorized to represent and bind a legal entity and the membership must not be cancelled by Scyllium due to a violation of this contract by the seller. For underage or legal person members; applications made through persons who are not authorized to represent and bind a legal person or, as mentioned above, applications made by persons whose membership has been cancelled by the seller due to a violation of this contract, even if the Site registration process has been completed, it prevents the use of the rights being by membership.

4.3. From the moment a member starts using the Site, Agrees that it will be deemed to have accepted all the terms of the contract and that these terms will be binding on it. 5. Rights And Obligations Of The Parties

5.1. Member's Rights And Obligations :

5.1.1. 5.1.2. A member may not given the password provided to him by Scyllium to other persons or organizations, the member has the right to use personally the password in question. With all the responsibility that may arise for this reason against all claims and demands that may be brought against scyllium by third parties or competent authorities, to be with it Scyllium has the right to appeal to the member  in addition all rights to compensation and other claims arising from such unauthorized use are also reserved.

5.1.3. 5.1.5. Member has been agree not to access or use the software and data of other internet users without permission. Otherwise, the civil and criminal responsibilities arising from this belong entirely to the member.

5.1.6. A member who violates one or more of the articles counted in this membership contract, is personally liable for this violation, both criminally and legally, member is personally liable for this violation, both criminally and legally, Scyllium will be free from the civil and criminal consequences of these violations. In addition, due to this violation, if the event is transferred to the field of law, Scyllium reserves the right to appeal to the Member for compensation and judicial/administrative fines that may arise, as well as to claim compensation against the Member for non-compliance with the membership contract.

5.2. Rights And Obligations Of Scyllium:

5.2.5. Scyllium may change, update or cancel the terms of the membership contract at any time without pre advice and/or notice. Any provision amended, updated or repealed shall mean the provision for all members at the date of publication.

5.3 Rights and Obligations related to The Protection Of Personal Data:

5.3.1. 5.4. The parties agree that all computer records belonging to Scyllium are the only and true Exclusive Evidence, HUMK would be based in accord with Article 287 and it accepts and declares that these records constitute an evidentiary contract.

5.5. The risks associated with links (links that lead to different internet sites) on the Site for the purpose of providing information and convenience to visitors belong to the Member. These links are provided by Scyllium in the content of the site only for the purpose of providing information and convenience to visitors.

6. Transfer Of Contract

Member irrevocably accepts, declares and undertakes that Scyllium may transfer the contract to third parties and has already authorized the transfer of the contract in accordance with Article 205 of the Code Of Obligations under this Contract.

7. Cancellation Of Contract

This Contract shall remain in force until the member cancels its membership or cancels its membership by Scyllium. If a member violates any provision of the membership contract Scyllium may terminate the contract unilaterally by canceling the member's membership.

8. Settlement Of Disputes

The legitimacy, interpretation and act of this contract is governed by the laws of the Republic of Turkey. Istanbul Central courts and Executive Offices are authorized to resolve disputes that may arise from the application of this Contract.

9. General Provisions

9.1. The e-mail address provided by the member when registering on the Site is considered the legal notification address for any notification to be made in relation to this Contract. In certain parts of the site, different rules and obligations specific to the relevant section may be determined. A member using these sections is considered to have read and accepted the relevant rules.

9.2. In case the parties do not notify the other party of changes to existing email addresses within 3 (three) days, they agree that notifications to old email addresses will be valid and will be considered made to them.

9.3. Any notification made using by the registered email address of the member, 1 (one) day after the e-mail is sent by Scyllium, to the member will be consider to have reached. The member declares, accepts and undertakes that he has read, understood, accepted all of the articles contained in this Contract and confirms the accuracy of the information he has provided.

10. Validity

Registration of membership means that the member has read all the articles contained in the membership contract and has accepted the articles contained in the membership contract. This Contract was written at the time of the member's becoming a member and entered into force mutually.
